Rules and Regulations

These rules and regulations define the terms and conditions of using the GAPS (Gdańsk Art in Public Space) project website, available at gaps.gda.pl.

 

§ 1

The terms used in these rules and regulations, further referred to as the Rules and Regulations, shall have the following meaning:

  1. GAPS – website of the GAPS (Gdańsk Art in Public Space) project, available at gaps.gda.pl.
  2. Administrator – administrator of the GAPS website, that is the ŁAŹNIA Centre for Contemporary Art, ul. Jaskółcza 1, 80-767 Gdańsk, Poland, NIP (tax ID no.): 5832552296, REGON (statistical no.): 191571237. The ŁAŹNIA Centre for Contemporary Art is a cultural institution subordinate to the local government, entered in the Register of Cultural Institutions kept by the Municipality of Gdańsk under RIK 6/98. It operates on the basis of the Municipal Local Government Act of 8 March 1990 (Polish Journal of Laws of 2001, no. 142, item 1591, as amended) and the Organisation and Operation of Cultural Activity Act of 25 October 1991 (Polish Journal of Laws of 2012, item 406). The ŁAŹNIA CCA is organised by the Municipality of Gdańsk. With respect to its duties of Organiser, the ŁAŹNIA CCA is supervised by the Mayor of Gdańsk.
  3. Resources – digital copies and content available on the GAPS website, including in particular descriptions of works and art objects, photographs, sightseeing routes and their descriptions. GAPS resources constitute works within the meaning of the Copyright and Related Rights Act of 4 February 1994.
  4. Users – natural persons using the GAPS Resources, acting in their own name or on behalf of interested entities,
  5. Rules and Regulations – these rules and regulations.

 

§ 2

  1. GAPS is a website operated by the Administrator – ŁAŹNIA CCA.
  2. The Administrator exercises technical supervision over GAPS operations, stores digital copies of Resources and supervises the content of Resources published on the website.
  3. The main service offered by GAPS is the possibility to view materials selected by Users from among the Resources published on the website, available at: gaps.gda.pl.
  4. The Resources published on the website are owned by the Administrator or the Administrator’s partners and are subject to legal protection, in particular under copyright law.
  5. Any and all rights to the GAPS website and all of its elements, including graphic layouts and elements, are held by the Administrator and are subject to legal protection, in particular under copyright law. 
  6. Copying and using any protected elements of the GAPS website in breach of these Rules and Regulations constitutes a violation of the Administrator’s rights.
  7. The Administrator shall not be liable for any infringement of third-party rights by using copies of the Resources in breach of these Rules and Regulations, the copyright law and related rights, or other legal regulations.

 

§ 3

  1. Use of the GAPS website is voluntary. In order to use the GAPS website, Users are obliged to read and accept these Rules and Regulations.
  2. Users shall use the GAPS website in accordance with the law and with social and moral norms.
  3. Using, watching and browsing through resources published on the GAPS website by Users is free of charge and does not require logging in.
  4. Any and all use of GAPS Resources has to comply with copyright law, related rights and other legal regulations. Users have the right to use GAPS Resources for research, dissemination, explanatory, educational and polemical purposes and for the purpose of a critical or academic analysis. Users using the Resources shall each time be obliged to indicate the source of the quoted Resource (project name and website address: GAPS, gaps.gda.pl) and identify the authors of the quoted content.
  5. Users are not authorised to reproduce GAPS Resources, sell or otherwise dispose of and distribute Resources, in whole or in part, for commercial purposes. Using GAPS Resources is only possible for research, dissemination, explanatory, educational and polemical purposes and for the purpose of a critical or academic analysis.
  6. Any violation of intellectual property rights, copyrights and related rights shall result in criminal prosecution of Users.

 

§ 4

  1. GAPS allows Users to submit proposals to expand Resources available on the website, using the “Suggest an object” tab.
  2. Content sent via the “Suggest an object” tab will not be published on GAPS. Proposals sent by Users are verified by persons running the GAPS website. Following the verification, the proposed object is processed by the GAPS expert team in terms of providing a description of the work of art and its photographic documentation. 
  3. The aforementioned sharing of content via the “Suggest an object” tab does not result in any material copyrights to content published on the GAPS website being transferred to the User.
  4. Sharing content with GAPS via the “Suggest an object” tab is free of charge. Users are not entitled to remuneration or compensation for content shared via the “Suggest an object” tab.
  5. In some cases, the Administrator reserves the right to contact the User proposing an object in order to establish cooperation in the scope of creating descriptions or acquiring archival materials.
  6. Users believing that Resources published on the GAPS website infringe on their rights should notify this fact to gaps@laznia.pl or via any other means of contact available at gaps.gda.pl.

 

§ 5

  1. The Administrator shall have the right to amend these Rules and Regulations at any time without stating the reason.
  2. Any matters not regulated in these Rules and Regulations shall be governed by Polish law, including the Civil Code.
  3. These Rules and Regulations shall enter into force as of the publication date on gaps.gda.pl under https://gaps.gda.pl/regulamin/, substituting the previous version of the Rules and Regulations.
  4. The Administrator, authors of the GAPS website and its Resources shall make every effort to ensure that the published Resources are complete, accurately described and corresponding to the factual condition. Despite these efforts, Resources may contain unintentional errors and omissions, for which the Administrator and authors of the GAPS website are not responsible.
